The following Terms and Conditions apply to any travel arrangements and/or services booked with or bought from Destinasia Tours & Travel Pvt. Ltd., and govern the contractual relationship between the clients and Destinasia Tours & Travel Pvt. Ltd. with respect to any such travel products and/or services (hereinafter, the “Products”).  Hence please read below Terms and Conditions carefully.

 

AGREEMENT

By accessing, using, browsing and/or booking through our Website(s) or directly or indirectly through Destinasia Tours & Travel Pvt. Ltd. or its representative(s), any product or by travelling on a Destinasia Tours & Travel Pvt. Ltd. tour or product, you acknowledge that:

You have thoroughly read and understood these Terms and Conditions.

Indicate your express acceptance and agree to be bound by our company Terms and Conditions, and also agree to comply with all applicable laws, rules and regulations.

If you have confirmed a booking on any Product(s) with more than one client named and booked on such booking, you shall be deemed to have accepted these Terms and Conditions on behalf of all clients named in the booking and travelling on or otherwise participating in any Products, and by such travel or participation all your co-passengers indicate their assent to these Terms and Conditions.

The client who confirmed the booking is deemed to be the designated contact person for all other clients named in such bookings. These Terms constitute the entire agreement between the Client and Destinasia Tours & Travel Pvt. Ltd. with respect to the subject matter thereof superseding all prior agreements, representations and understandings of the parties, written or oral.

 

PAYMENTS

For the services contracted, advance payment has to be made to hold the booking on a confirmed basis before arrival to India. Destinasia Tours & Travel Pvt. Ltd. reserves the right to decide upon the amount to be paid as advance payment, based on the nature of services, vendor requirements and/or the time left for the commencement of the services.

 

MODE OF PAYMENT

Advance payment, as well as any payments thereafter, can be made through Payment Gateway / Wire Transfer to our bank account. The transfer/processing charges levied by the bank need to be deposited in addition to the payment amount. Based on the transactional requirements, advance payments can be made through one of the following methods:

Visa / MasterCard / Diners / American Express Credit Card

Bank  Wire transfer

Banker’s Cheque / Bank Draft (For Indian Resident only)

We do not accept payments through cheque for overseas booking.

In case of payments through a Credit Card, the bank transaction charges, as applicable, would be levied over and above the total amount.

NO SHOW / EARLY DEPARTURE / CANCELLATION POLICY

REFUND POLICY

In regard to refund of unused / unutilized services (which are paid for and cancelled in advance) the refund amount would be calculated on the basis of CANCELLATION POLICY as described in this website and the money would be accordingly refunded to the person who has made the payment to us.

Any refund against a payment received through a Credit Card, will be made on the same credit card only. Please note that the refund process may take 2 to 8 weeks due to banking procedures.

No deductions will be made for the refunds (except the transaction charges), which are made due to unavailability of services. If the services requested are unavailable during the requested period, we will offer similar alternatives well before the commencement of the services and if the client does not find the alternatives acceptable, the advance will be refunded. However, once the alternative service is accepted by the client, cancellation of the same will be subject to the above stated cancellation policy.

 

GENERAL TERMS

Destinasia Tours & Travel Pvt. Ltd. acts only in the capacity of agent for hotels, airlines, transporters, railways, and contractors providing other services. All exchange orders, receipts, contracts & tickets issued by us are issued subject to terms and conditions under which these services are provided by them.

The hotel ratings given on our web sites are established by qualified local authorities and do not reflect our opinion about the hotel or the service rendered by the hotel.

All itineraries are sample itineraries, intended to give you a general idea of the likely trip schedule. Numerous factors such as weather, road conditions, the physical ability of the participants etc. may dictate itinerary changes either before the tour or while on the trail. We  reserve the right to change any schedule in the interest of the trip participants’ safety, comfort and general well being.

We do not have any insurance policy covering the expenses for accident, sickness, loss due to theft, or any other reasons. Visitors are advised to seek such insurance arrangements in their home country. All baggage and personal property at all times are at the client’s risk.

 

FORCE MAJEURE

Destinasia Tours & Travel Pvt. Ltd.  shall not be liable in any way to the Client for death, bodily injury, illness, damage, delay or other loss or detriment to person or property, or financial costs, both directly and indirectly incurred, or for Destinasia Tours & Travel Pvt. Ltd.’ failure to commence, perform and/ or complete any duty owed to the Client if such death, delay, bodily injury (including emotional distress or injury), illness, damage or other loss or detriment to person or property is caused by Act of God, war or war like operations, mechanical breakdowns, landslides, terrorist activities or threat thereof, civil commotions, labor difficulties, interference by authorities, political disturbance, howsoever and where so ever any of the same may arise or be caused, riot, insurrection and government restraint, fire, extreme weather or any other cause whatsoever beyond the reasonable control of Destinasia Tours & Travel Pvt. Ltd.; or an event which Destinasia Tours & Travel Pvt. Ltd. or the supplier of services, even with all due care, could not foresee.

 

COMPLAINTS REGARDING BOOKED SERVICES

Any suggestions from the client will be gladly accepted in order to improve the level of services and accommodation provided. We welcome your feedback, comments and/or complaints regarding the services purchased through us.

Destinasia Tours & Travel Pvt. Ltd. takes all reasonable care to make sure that all the services are provided to a reasonable standard and are provided as described in our Websites. However, we shall not be responsible for any changes made by the supplier of which we have not been informed.

Destinasia Tours & Travel Pvt. Ltd. will not be responsible for any lapse in services provided by a third party vendor like a hotel. We take reasonable care while patronizing a hotel; however, may not under any circumstances guarantee the standard of services provide at the hotel.

 

E & O E (ERRORS AND OMISSIONS EXCEPTED)

Destinasia Tours & Travel Pvt. Ltd. will not be responsible for any human error or typing error, which has gone unnoticed by the client or the company’s staff.

 

MODIFICATION OF THESE TERMS AND CONDITIONS

Destinasia Tours & Travel Pvt. Ltd. reserves the right to amend/modify the terms, conditions, and notices as suitable in the interest of the clients and the company; and to comply with the legal requirements governing the industry.

 

LEGAL JURISDICTION

Disputes, if any, shall be subject to the sole jurisdiction of the Civil Court of New Delhi, India.
